Srinagar : The Anti-Corruption Bureau (ACB) on Tuesday said it has filed a charge sheet before the Special Judge, Anti-Corruption Court, Baramulla, against the former District Development Commissioner (DDC) of Bandipora and four others for allegedly facilitating an illegal government appointment, causing wrongful gain to the beneficiary and loss to the government exchequer.
In a statement issued to the news agency, a spokesperson said the ACB, Jammu & Kashmir, presented a charge sheet before the Court of Special Judge, Anti-Corruption, Baramulla, against five accused persons, including the then District Development Commissioner, Bandipora, in FIR No. 08/2017 of Police Station ACB Baramulla.
The accused have been charged under Section 5(1)(d) read with Section 5(2) of the Jammu & Kashmir Prevention of Corruption Act, Samvat 2006, and Section 120-B RPC in connection with an alleged illegal and fraudulent appointment, the spokesperson said.
The spokesperson said, the case originated from a verification conducted by the ACB, which revealed that a person initially engaged purely on a temporary basis as an Orderly in Bandipora district was subsequently illegally and fraudulently projected and treated as a regularly appointed government employee without any lawful order of appointment or regularisation.
During the investigation, it was found that official records, including the service book, were allegedly prepared, processed and authenticated in a manner that enabled the beneficiary to draw regular salary, service benefits and consequential promotion without lawful authority, the spokesperson said.
The investigation further revealed that the beneficiary allegedly received unauthorised salary and consequential service benefits, resulting in wrongful gain to the beneficiary and a corresponding loss to the government exchequer.
The spokesperson said that upon completion of the investigation and after obtaining the requisite prosecution sanction against the serving public servant, the ACB filed the charge sheet against Mushtaq Ahmad Sheikh, the then District Development Commissioner, Bandipora (retired); the then Executive Engineer, Irrigation Division, Sumbal (retired); Mohammad Ramzan Ganaie, the then Head Clerk, Irrigation Division, Sumbal (retired); Tariq Ahmad Khan, the then Establishment Clerk, Irrigation Division, Sumbal (now Senior Assistant); and Nisar Ahmad Itoo, the beneficiary accused, presently serving as Junior Assistant.
The investigation prima facie disclosed that the accused public servants, in furtherance of a criminal conspiracy and by abusing their official positions, facilitated the unauthorised conferment of government service benefits upon the beneficiary, resulting in wrongful gain to the beneficiary and a corresponding loss to the government, the spokesperson added.—(KNO)
