Introduction to where does a Lok Adalat find its place in the Indian legal system They are a fast, economical and social way of dispute resolution. The government introduced the Lok Adalat system (people’s court) to cut down the pendency of cases in regular courts and give a chance to people from poor backgrounds or in remote areas to resolve their disputes quickly and at little cost.
Lok Adalats are on without prejudice to compromise and therefore the litigants arrive at a mutually acceptable settlement. These include courts that deal with civil cases such as property disputes, family issues, labour disputes etc. They also decide misdemeanour cases where the punishment may be uncalled for. If a case is settled in a Lok Adalat, the award passed by it would be final and binding on the parties to the dispute and no appeal will lie before any court against their settlement.
The quickness of Lok Adalats is one of their main merits. In India, traditional courts frequently have hundreds of cases pending, which might take years to be resolved. In comparison, cases in Lok Adalats are typically resolved within a single day. This is a huge advantage for those who require speedy settlements of their conflicts. The fact that Lok Adalats are free of charge means that people don’t have to worry about paying high legal bills, which is another benefit.
Regular Lok Adalats would be highly beneficial for the people of Kashmir. Numerous difficulties have been faced by the area, such as social unrest, economic hardships, and hostilities. Many people in Kashmir deal with legal problems of land disputes, family troubles, and even minor criminal charges as a result of these difficulties.
Regular courts in the region are already overburdened, and adding more cases to their workload only delays justice. The Valley’s regular courts are already overworked, and taking on extra cases will only cause justice to be delayed. Frequent Lok Adalats could alleviate the backlog on traditional courts while facilitating prompt and equitable resolution of these legal disputes. People would see that justice can be delivered fairly and promptly, which would contribute to an increase in public confidence in the legal system.
Additionally, Lok Adalats can be extremely helpful in lowering social tensions and bringing about peace in Kashmir by providing an easily accessible and reasonably priced forum for justice.
Lok Adalats offer a straightforward, practical, and easily accessible method of settling conflicts. In order to ensure justice for everybody and reduce burden on the official legal system, it would be beneficial to increase the frequency of Lok Adalats in Kashmir.
